If you killed a serial killer, would you get charged with murder?

December 30, 2009 · Filed Under Law & Ethics

Jed asked:

If you killed a serial killer, would you get charged with murder? What is the laws approach to this issue? ie. Is murder murder in the eyes of the law, whatever the scenario?
Okay not in self defense. They are not harming you in any way. You just dont have any incriminating evidence on them and provided you dont stop them, they will kill more.

If you murdered the murderer, then you would be charged with murder.
It is murder in the eyes of the law regardless the victim.
Unless you were defending yourself or another person.

It depends on the situation, country, state, etc.

If you were in the US, and he was trying to kill you…then NO, you would not get charged for self defense. If you used a knife, gun, choked him/her…whatever…you would be safe.

Now in the UK, there was a man who had a gun for hunting. And these people who were going home to home robbing them went into this guy’s house. He shot 1 dead and the other in the back. He was sent to prison for 15 years even though he was defending his property. So in the UK, using a gun would not be allowed. But I suppose you can try choking the killer.

Just depends on weapon used, and the instance.

Now if you were robbing a gas station, and the serial killer happened to be there…you didn’t know it…and you shot him dead. Then yes, you will still be charge because it was a seperate crime…regardless of what the person had done.

Yes murder is murder. Unless it is a state execution.

of course youd be charged with murder.
it always depends on the scenario, law is never black and white.
were you in immediate danger of this serial killer? is that the only reasonable way to get out of this danger? did you use reasonable force? etc. there are lots of things that factor into it.

    help with mine?

Very briefly - yes. Murder is the UNLAWFUL killing of another person. It would be up to the Courts to decide whether you ( or whoever was responsible) had justification in doing so. Killing someone ( assuming it’s not self defence) is bordering on vigilantism.
Countries have different laws but I think you’ll find that this would be the basic premise.

Everybody deserves a trial. Unless you catch them in the act, don’t shoot them. If you must, don’t shoot to kill.

lol. I used to think murder in these cases was lawful when i was young. Hey, if the police are doing it why can’t we? haha In Australia, you could completely get off murder, in cases where you’re insane, murdering in self defense, or necessity-(where the outcome of not committing the crime is worse than the crime being committed). This was used in a US case US v Holmes, where a man threw 8 people overboard a raft becuase they were the weakest, arguing there was not enough food and water & that in doing so, he saved the lives of many other people. HE won the case on these grounds as the court ruled in his favour. However, you don’t take the law into your own hands in your situation. Only police have this power. I doubt you could say it was on grounds of neccessity.. Thanks for asking this question. Its helping me remember stuff for a test :) Also, tosuccessfully convict for murder:- act took place with deliberate intention to kill
