Should people who smoke in public be charged with attempted murder?

May 23, 2010 · Filed Under Respiratory Diseases

vh asked:

It seems to me that people who smoke in public or even at home in the presence of non-smokers is exposing others to poisonous gases. Tobacco smoke may not kill you instantly but it can cause cancer, emphysema, various respiritory conditions, and even other types of cancer besides lung cancer. Breathing second-hand tobacco smoke can be very dangerous to people who have respiritory problems. I think it should only be legal to smoke outside on your own property. It should only be legal to smoke in your own house or apartment if no non-smokers live in your household. Smoking in ANY public place should be illegal. What do you think?

no, im not a smoker and i believe taking away their right is ridiculous. People are informed of the implications of smoking and the effects on their health and others. many restaurants are now becoming smoke free, and public places such as amusement parks, swimming areas etc.

I have no problems with banning people from smoking in public places but the idea that someone could be charged for murder is ridiculous.

I think you should move to Ohio. Those are the laws here. You cant smoke within something like 50 feet from an entrance to a building, or in restaurants. If it is your own house the non-smokers can just move.

No, there are so many other pollutions in the air that you can’t blame tobacco smoke. Look at all the respiratory problems that are now coming out about the people who breathed in the dust from 911. My grandfather died from black lung but it was working in a grain mill. When we have totally clean air then I’d say yes.

I think that’s completely ridiculous, I don’t smoke anymore, but when I did nobody ever had a problem with me smoking around them. If they did they would either ask me to put it out (which I kindly did) or just leave. You are not going to get any respiratory symptoms from a little second hand smoke. If you don’t like it you can leave, you don’t have to stand right next to the person.

You are a paranoid advocate of a nanny state. Risk of cancer is only increased slightly by exposure to secondhand smoke. You expose your children to more cancer risk by taking them to the beach. You are going to die anyway someday. Relax.

Should people who drive over 55 mph be charged with attempted murder? I think NOT.

No. You’re whiny. Live involves many dangers. Embrace the danger. Hug the danger, get to know the danger. Don’t live every day in fear. No matter how hard you try to avoid it, you will die. Crying about it won’t help.

Only if they charge a DUI similarly, “attempted murder.”

Heck, they can’t even make that charge towards someone that swipes at you with a knife if they don’t actually wound you. It would be attempted assault, yet that swipe could’ve been fatal. None of us knows.

At the end of the day, one inhalation of 2nd-hand smoke isn’t going to be fatal, so I don’t think this idea will work.

I guess we’ll have to take cars, trucks, buses off the road too. Can’t use gasoline or oil. Better get rid of the microwave while your at it. And how about those x-ray machines. The color red, and blue are not good either. Synthetic fibers, Sugar cereal, pets, people with diseases. We breath so much junk in every day. Don’t stand near someone who’s smoking. It is your right to ask them not to smoke when you are around. But if we start taking rights away, we take freedom away, and we all have read what that’s like.

    Sure!

Also people who cough in public should be jailed immediately!!

Why don’t you get a life hey. Fair enough that smoking is restricted from enclosed areas but ANY public place?

this is why i hope and pray we never end up with a president like yourself…

NO.. i bet you do other things like drink alcohol…? that has long term affects too but i dont hear anyone complaining..???

i use to be a full time smoker and gave up 6 months age for good, because i know i was doing damage to myself
i believe people who want to smoke .. Should be allowed to wherever they want as long as they respect everyone else who doesnt smoke at the same time.
YOU BEING A NON SMOKER… should have the brains to not stand in the cigerette smoke…. or to avoid it when you see it.

    take your pathetic laws elsewhere…!

    Yes, I agree with you.
It just kills me when I see people smoke in a vehicle with a child in it. I hope they start giving out tickets for that soon.

Remember the old bill boards along the expressways and highways? They still have them. Instead of advertising the Marlboro Man or the Camel guy, they could show people like me. I have COPD. I am on oxygen 24/7. I have end stage which means there is nothing left they can try on me that they haven’t already. They can sit me in the wheelchair with my oxygen tanks next to me and all my inhalers/meds sitting on a table next to me. The board could say something like, “This WILL be you. ENJOY that smoke”! Then have a child about 5 standing next to me coughing. Then it says, “If you don’t think of yourself, what about them?”

What do you think of that idea?

We should also not allow people to go out without sunscreen since sun exposure causes cancer, and we need to make all fatty foods illegal since it causes heart disease, lets also forbid alcohol which damages the liver, no more loud music that hurts our ears, no more coffee since the caffeine can raise our blood pressure, do away with sugar because we’ll get diabetes and we should outlaw cars since they pollute the air which aggravates my allergies.

Smoking has never been proved to “cause” any of those things you mentioned. Yes there are a lot of links between smoking and those conditions you mentioned, but not proof of actual cause.

Even without smoking or even being exposed to cigarette smoke you can get lung cancer, emphysema, various respiratory conditions.

But if people who smoked were charged with attempted murder. Then these below should also be taken into account.

Heart disease is the #1 killer in America right now. Food companies are shoving foods that are made with High-Fructose Corn Syrups and Hydrogenated fats. Should every food company be charged with attempted murder? No.

Also there is over 6 million car accidents per year in the United States, however not all are fatal. Should car companies be charged with attempted murder? No way.

Most big factories are blowing smoke into the air, not to mention vehicle emissions. Should everyone who works in a factory or drives a car be tossed in jail for attempted murder? Never.

    +=+=+
I do not like smoking or inhaling second hand smoke. There are a lot of public places that do not allow smoking in their facilities, which is good. But it is just something we have to live with. We all have a free will and have a choice to where we go. It is not 100% avoidable, yes it does suck, but we just have to deal.

NO……….. There are many other reasons that people acquire those same diseases. I happen to think that people should be worrying more about the state of our country and the economy. Especially the politicians that waste money and time on something that’s been happening since before Columbus discovered America.
This Is Still America ~ isn’t it?
Outlawing it will only make people resentful…
Honestly…..Don’t people have other things to think about?? How about Drugs, Crime going rampant, etc. etc….etc…….
