Will the Walmart shoppers that stomped & killed the employee be charged with murder?

Sammy asked:
I don’t see a difference between someone being shot or being stomped on by a bunch of people, so will the group of people that stomped & killed the walmart employee be charged as a group with murder?
or will they get off scott free & walmart just be sued for several million dollars by the family of the worker killed?

Manslaughter at the most.

They are studying the tapes. It just saddens me to no end every time I think about it. There was no emergency, no fire, no shooting, just a sale on TVs that could have been purchased over the internet.

I do not believe the customers will have any charges pressed against them. First, you have to prove upon a reasonable doubt that the person actually knew someone was on the ground and they stomped on the person. I am sure no cameras are going to be pointing at the ground to show the person foot stepping on the victim. Yes, Walmart will get sued because they ARE at fault because they did NOT have control of the crowd nor enough security to control the crowd. I believe they were negligent.

Yes its called reckless homicide. Even if they didn’t mean to kill someone, because of there reckless actions that man lost his life. As far as them pressing charges on them, i couldn’t tell you. That’s up to that local PD to decide. Personally, i would.

I’m sure they won’t find them.

I would think that they could be charged witn “involuntary manslaughter”.
Although they most likely didn’t purposely try and kill the guy, their reckless behavior was responsible for the death. And I imagine they could care less, and would probably do it again. People such as this really do not have much value on human life. They were still wanting to shop! Makes me certainly wonder about the people in this area. Must be animals.
People definitely need to be charged in this case so maybe in the future, even morons will stop and think.

First of all, Walmart was not responsible for this. That crowd took the doors off the hinges. What is anyone going to do to conrol that? The police will not voluntarily guard stores. Those people were responsible, and I hope that whoever stomped on him remembers that they killed someone every time they look at their new tv.

If they can identify the people from the tape I think it will be extremely hard to prove that they were guilty if you are being pushed they could not stop or the same thing would have happened to them. I was crushed at a concert we were pushed up against the stage a little girl was popped up and deposited on the stage they made her get down with no place to go she ended up under the stage.
My question is how can they stop this from happening in the future like only limiting so many people in at one time or closing the doors.
It is such a tragedy My preyers go out to the family.
I wish I could come up with a salution. I live in Oregon and the Outlet Stores opened at anywhere from 9 pm until midnighThanksgiving night. It is just greed on the part of people and the stores. Maybe Walmart will decide to just go with regular hours Black Friday We have some that are open 24 hours I do not know how that would work.

There is no da** sale good enough to violently rip off the doors and run in like a bunch of maniacs pushing someone down to their death! The story is so sad it makes me very sad and angry at the same time. If I had been there and saw him on the ground, I would have done everything I could to have people go around him. How could you not know you are about to or that you just did step on someone and you’d just keep running to that bargain you’re there for? I hope these low lifes have a conscious and it eats them alive. No sale and not even free stuff warrants this behavior. I agree with you completely on being shot or stomped, it’s still killing someone whether it be murder or manslaughter. Let’s just hope they get caught.
I hope that everytime they look at that “bargain” they got, that it’s a reminder of what they did.

The people who did the trampling should be arrested and charged with manslaughter at least! They are total animals and should be caged!

I don’t think that they will be charged of murder, but some of the people in front who were caught on camera might be charged with some misdemeanor for reckless behavior, but probably not murder. At first I wanted to blame them too but at the same time, there was thousands of people behind them, pushing foward…so its hard to pin point any one, or even few people.
Walmart did not provide enough crowd control, they only had 1 security guard there. They should have coordinated better, when they advertised their big sales they should have been able to guess the size of the crowd. I honestly belive if anyone should be sued it should be the walmart.
And yes people continued to shop while police tried to resusitate the man, but dont forget they wouldnt be able to buy anything if the cashiers didnt ring it. Where was the store managers when this happened? All shopping should have stopped in honor of the incident.
