ROFL. Gene. asked:

For example: If I see someone getting beat up by 1 or 2 people, and I attack these people with a baseball bat and end up killing them. Can I be convicted of murder?

I’m not too sure, but wouldn’t manslaughter be a possibility in that situation even though you were acting in defence of someone else?

Murder? Absolutely not. It’s not murder. Manslaughter? No. Involuntary manslaughter? Maybe but very unlikely.

The district attorney’s office will most likely not change you, unless s/he’s a complete lunatic.

All i know is because it wasn’t your self defense then that can’t be used as like an excuse, if the person being attacked had killed him then it would be self defense. But in your case i think it would be different i mean there’s so guarantee because it would all be up to what the judge would think about it. Because you can’t prove that the he as really going to kill the other person and you just randomly jump in and kill him.

You can be charged with either murder or manslaughter if you kill someone while trying to protect someone else, depending on the details, as decided by a judge.
