Is it still murder if she changes her mind?

MetalHeart asked:
The boyfriend in Wisconsin that laced his girl friends smoothie with an abortion pill is being charged with murder for causing the pregnancy (twice) to miscarriage.
If the girlfriend was to come back and say, I probably would have had an abortion anyway or something to that effect, could the man still be charged with murder? Would it still morally be considered murder or would it then be considered her “choice” since she could technically have had an abortion anyway?

Yes, because advance consent was not given.
If a doctor was doing surgery on a sedated pregnant patient and said “while I’m at it, I’m going to just abort her pregnancy” and did so without authorization, he wouldn’t be any less culpable if the woman woke up and said “you know, that was a good idea. Thanks!”

I think there is a huge difference between drugging someone unknowingly or being a person giving consent to a procedure knowing all risks involved.
Any time you take the day after pill there are a certain amount of risks that a woman should be aware of. But if someone just slips it to you, you have no idea what’s happening to your body.
I couldn’t even imagine how I’d feel if one moment I was happily pregnant, then next moment I’m cramping and bleeding horrendously.
It was her choice to make not the guys!

Even if she wants him to do it it is illegal for a non-doctor to perform an abortion.
The case has come up where both people wanted it and the man and woman together aborted the fetus at home. The man was charged with murder, the woman was not charged with anything.

Yes, you cannot consent to something illegal and a felony , and turn it into a lesser crime.
